Planning and Zoning
Planning and zoning promotes the creation and maintenance of a livable community, insures the compatibility of adjacent uses, and helps protect the rights of all property owners. The zoning ordinance specifies the details of each district such as building setbacks and height, size and location of open spaces, and the intensity to which the land may be developed.
The Department of Community and Economic Development provides direction and leadership in implementing the goals, objectives and policies of the Comprehensive Plan, and is responsible for the orderly development of the City and the administration of various land use regulations, including zoning and subdivision.
When a property owner wants to develop or use their property in a way that does not conform to existing zoning regulations, they must go through a public hearing process to change the zoning.
Zoning regulations are found in Chapter 27 of the City of Yankton’s Code of Ordinances.
Areas located one mile or less from the City Limits are included in the Extraterritorial Jurisdiction (ETJ). Under South Dakota Codified Law communities may regulate land use to make sure that development on property occurring prior to annexation is compatible with long range community goals and infrastructure capabilities.
